ASA Urges Relief From ACA Penalties if Qualified Plans Were Unavailable

ASA has filed comments on proposed regulations issued by the U.S. Department of Health and Human Services regarding “minimum value” health plans under the Affordable Care Act. The proposed rule, which was published in the Federal Register on Nov. 26, would provide “transition relief” for employers that committed to non-hospital/non-physician (“MVP”) plans before Nov. 1, 2014. In its comments, ASA urges that the government grant relief even if an employer had not finalized its plan arrangements by the Nov. 1 cutoff date as long as it had made substantial progress in doing so. The comments also urge that similar relief be extended to any staffing firm that elected not to offer MVP plans for legitimate business reasons (e.g., because they believed the coverage was inadequate), or because it could not find major medical coverage in the current insurance market. Industrial Output Passes Prerecession Level

U.S. manufacturing output has risen past its prerecession level, suggesting the U.S. economy is in good shape. Factory output rose 1.1% in November, according to the U.S. Federal Reserve, and October’s figure was upwardly revised to a 0.4% gain, putting factory output in October above the last peak seen in December 2007.

Overall industries—a category that comprises manufacturers, utilities, and mining—are working closer to full capacity than at any time in more than six years. Capacity utilization rose to 80.1% in November from a revised October reading of 79.3%. Capacity utilization now is at its highest level since March 2008 and equals its average over the past 40 years.

The new ASA Safety Matters website—americanstaffing.net/safetymatters—features information and resources focused on protecting the rights, safety, and well-being of temporary workers, and educating staffing companies, their clients, and temporary workers about temporary worker rights and employer responsibilities under the Occupational Safety and Health Act.

The Safety Matters webpage details ASA’s alliance agreement with the Occupational Safety and Health Administration, tracks activities of the ASA Safety Committee and OSHA, and delivers employee safety best practices and instructional videos on the importance of protecting temporary workers in the workplace.
