In a major win for the staffing industry, the U.S. Department of Labor recently published an opinion letter clarifying the Fair Labor Standards Act’s “retail or service establishment” overtime exemption. The letter, issued at the American Staffing Association’s request, affirms that the exemption can apply to staffing firms, a departure from the agency’s prior position that staffing firms categorically could not qualify for the exemption under any circumstance.
