Participate in the ASA Quarterly Staffing Employment and Sales Survey

Trump Administration Counterpunches After Game Changing H-1B Court Decisions

In May 2020, ASA reported on some significant court decisions that struck down many of the Trump administration’s narrow interpretations of H-1B visa regulations that were resulting in 35% or more of H-1B cases getting denied and an even higher number receiving very short validity periods of one year or less. Following those decisions, staffing firms were able to rely on much more consistent adjudications for the full three years requested, fewer requests for evidence, and fewer denials.

With an election looming, the Trump administration has fast-tracked two very significant regulations that directly affect professional staffing firms that rely on H-1B workers and that attempt to override those court decisions. On Oct. 8, 2020, both the U.S. Department of Labor and U.S. Department of Homeland Security published regulations that so drastically change the H-1B visa application process that they effectively eliminate many staffing firms’ access (and their end clients’ access) to this labor pool.

Groups are preparing to file suit against the regulations.
