Justice Department Is Leading Government Crackdown on PPP Fraud

The U.S. Department of Justice issued a news release on Friday describing an “historic level of enforcement” to combat fraud under the Paycheck Protection Program. In an email, ASA counsel Miller & Chevalier advised that the Justice Department has to date focused on the most egregious conduct, such as blatant misuse of funds and knowing falsification of loan and forgiveness application documents. But the firm cautioned that, based on its experience with such matters, it believes that “enforcement eventually will target even well-intentioned small businesses with allegations of false certifications and inaccurate payroll/expense calculations.”

The firm is reminding its PPP clients of the importance of preparing now for their SBA audit, ideally before seeking loan forgiveness. “Businesses that are prepared will have the smoothest audits and, in turn, are the least likely to face SBA Inspector General or Justice Department scrutiny down the road,” the firm said.
