Illinois Pauses Proposed AI Employment Rules for Agency Collaboration

The Illinois Department of Human Rights has temporarily postponed its upcoming public hearing and withdrawn proposed administrative rules regarding artificial intelligence in employment decisions. Originally scheduled for June 10, 2026, the hearing was set to address new notice and transparency requirements under Public Act 103-0804. According to state officials, the temporary pause is necessary to allow the IDHR additional time to collaborate with other state agencies and thoroughly review the framework before moving forward with the formal rulemaking process.

Public Act 103-0804 is designed to establish strict oversight for employers utilizing artificial intelligence and automated decision-making systems during the hiring and employment cycles. The core tenets of the legislation demand increased corporate transparency through mandatory applicant notifications and require safeguards to ensure algorithmic tools do not inadvertently discriminate against protected classes. While the formal 45-day public comment period is effectively on hold during this interagency review, the IDHR intends to reschedule the public hearing and release updated guidelines for submitting written comments in the near future.
