ASA Quarterly Survey Closes This Week—Participate to Get Free Staffing Employment and Sales Data

The association’s quarterly Staffing Employment and Sales Survey for the third quarter of 2021 is open until this Friday, Nov. 26. Staffing companies that complete the brief survey receive an exclusive report on the results, which includes gross margin and sector-level data.

Apply to Participate in an ASA Staffing Firm Owners Peer Group

ASA is currently accepting applications for peer groups for staffing firm owners. There are a limited number of spots available for 2022. Peer groups meet virtually for one hour each month, giving you the opportunity to network with colleagues in similar roles facing similar challenges. Submit your application by Nov. 17.

OSHA Emergency Temporary Standard Mandating Covid-19 Vaccines or Testing Clears Key Review Step

The U.S. Occupational Safety and Health Administration’s Covid-19 vaccination and testing mandate for employers with 100 or more workers has been cleared by the U.S. Office of Management and Budget’s Office of Information and Regulatory Affairs. OMB review generally is the last step in the review process setting the stage for official publication, which could come in days. Business groups, including ASA, have been meeting with the Biden administration to discuss their concerns with the ETS. In its meeting with officials last month, ASA asserted, among other things, that the high turnover of staffing agency temporary employees would impose disproportionately high testing costs and proposed that the ETS exclude employees expected to work fewer than 30 days. Recent reports suggested that the final ETS will allow employers to pass testing costs on to their employees, which would address those concerns. Any rule that is issued is expected to face immediate legal challenges that would almost certainly delay implementation.

New ASA Issue Paper Explains the Vaccine/Safety Mandates for Federal Workers

ASA has published a new issue paper that discusses the recently issued government rules that, with limited exceptions, require employees working “on or in connection with” a federal contract to be vaccinated, wear masks, and maintain physical distance. The paper covers the key provisions and effective dates, and addresses several scenarios staffing agencies likely will face and when the rules are likely to apply. The authors are federal contract experts with the Washington, DC, law firm of Miller & Chevalier, which represents ASA on tax and other complex federal regulatory matters.

Court Dismisses Background Check Class Action Against Staffing Firms

A Georgia District Court recently denied class certification in a Fair Credit Reporting Act class action case against two staffing firms, holding that although the staffing firm that procured candidates’ background checks was not listed on the FCRA authorization documents, such staffing firm was an authorized agent of the listed staffing firm. Therefore, the staffing firm defendants fulfilled the FCRA’s statutory notice and authorization prerequisites and the plaintiff lacked standing to bring the class action.

Staffing firms conducting and using criminal background checks are subject to complex requirements, including the Fair Credit Reporting Act and guidelines from the Equal Employment Opportunity Commission, and staffing firms should carefully review their FCRA disclosure documents with knowledgeable legal counsel to ensure compliance.
