Help Clients Understand Their Obligations With the Updated Joint Employment Tool Kit

Are your clients confused about the various laws and rules pertaining to joint employment in third-party staffing arrangements—especially in light of the U.S. Department of Labor’s recent rescission of the Trump-era joint employer legal test? To assist members in addressing client’s questions and concerns regarding joint employment, ASA has updated the ASA Joint Employment Tool Kit.

The tool kit offers a collection of resources to help staffing companies address client concerns about co-employment (the relationship between a staffing firm and its client in which each has legal rights and duties with respect to the same employees), including updated fact sheets, issue papers, and sample letters to clients that dispel myths regarding joint employment and explain how working with a staffing agency can actually protect clients from liability. It’s free to ASA members.

New ASA Issue Paper Warns of Worker Misclassification Risks in Long-Term Health Care Settings

The new, stricter worker classification rules published by the U.S. Department of Labor (as reported in Staffing Today on Jan. 9 and 11) point up the importance of clients using staffing firms that operate as employers and that classify their temporary workers as W-2 employee, not independent contractors.
A new ASA issue paper focuses on the particular risks of misclassification to workers, clients, and patients in long-term care settings, like nursing homes and assisted living facilities, that serve a vulnerable population.

Industry leaders say that the stakes for long-term care nursing are high, and that failure by policy makers to address the issues will mean a new era in which independent contractors become the new, lower, standard for providing patient care. ASA and its members have been pressing DOL and other regulators to step up their efforts to combat misclassification and encourage all staffing firms to assist in the effort by asking their state labor and workforce departments to take similar action.

ASA Publishes Update to Issue Paper Regarding I-9 and E-Verify

ASA published an updated version of its issue paper “Answers to Frequently Asked Questions About Form I-9 and E-Verify.” Written by outside immigration counsel Helen Konrad of law firm McCandlish Holton, the updates reflect the recent approval of a permanent, virtual verification option to complete Form I-9s, changes to the new Form I-9, and updated fines and penalty amounts. This issue paper is a popular resource available only to ASA members, and the latest version will allow members to stay current in this critical area of compliance.
