ASA Publishes Checklist for Borrowers That May Consider Seeking PPP Loan Forgiveness

The U.S. Department of the Treasury and U.S. Small Business Administration continue to issue updated guidance regarding the Paycheck Protection Program of the Coronavirus Aid, Relief, and Economic Security (CARES) Act. Recently, the government reminded borrowers about the good-faith certification of “necessity” required to obtain a PPP loan and stated that it may audit any business that has received PPP funding before granting loan forgiveness, particularly on loans in excess of $2 million.

In light of this guidance, ASA has published a checklist by Marc. J. Gerson and Alex Sarria of Miller & Chevalier Chartered. “Paycheck Protection Program—Preparing to Apply for Loan Forgiveness” identifies steps that PPP borrowers can take to support both their good-faith certification of loan necessity and any future application for loan forgiveness.

DOL Addresses Certain Staffing Clients’ Obligation to Provide FFCRA Leave

The U.S. Department of Labor has again updated its compliance assistance Q&As for the Families First Coronavirus Response Act (FFCRA). Most significantly, DOL added a question (question 90) clarifying who will be responsible for providing paid FFCRA leave in the staffing context. The Q&A provides that, where a staffing firm has more than 500 employees and thus is not covered by the FFCRA, and the client has under 500 employees and is covered, the staffing firm does not have leave obligations for temporary workers but the client will be obligated to provide the leave to such workers if it is a joint employer. DOL noted that a client likely will be a joint employer if it exercises supervision and control over work schedules or conditions of employment; DOL cautioned that a staffing firm cannot discriminate or retaliate against workers or interfere with their ability to take leave.

DOL has updated its guidance several times by adding more questions and answers since the law was passed in March, and the DOL website should be monitored regularly for additional updates.
