California Governor Signs Pay Transparency Bill

Yesterday, California Gov. Gavin Newsom signed Senate Bill 1162, which will require staffing agencies to report to the state temporary employees’ annual “pay data” by race, ethnicity, and sex, and also require clients to submit separate reports covering the employees provided by the agency. The bill additionally will require staffing agencies to include pay ranges in job ads. SB 1162 will become effective Jan. 1.

ASA; California Staffing Professionals, an ASA-affiliated chapter; and lobbyists Mike Robson and Bridget McGowan of Edelstein Gilbert Robson & Smith LLC engaged in extensive and prolonged advocacy efforts and were able to amend the bill to remove an extremely onerous provision that would have required clients to advertise job openings to their internal staff before using staffing agencies.

ASA will work with the California Civil Rights Department on clarifying and potentially mitigating FAQs, and will keep members informed of developments.
